CRIMINAL PROCEDURE

◾Introduction of the guilty plea and penal agreement procedures

Law No. 1.593 of 18 June 2026 (JDM No. 8805 of 26 June 2026) introduces into Monegasque law the guilty plea ("plaider coupable") procedure, allowing the Public Prosecutor to propose one or more penalties to an individual defendant who admits the facts, as well as the penal agreement ("convention pénale") procedure, allowing the Public Prosecutor to conclude an agreement with a legal entity or its representative who admits the facts, subject in both cases to the approval/validation of the President of the Court of First Instance.

◾Right to be forgotten and other measures to facilitate access to credit (increased health risk)

Sovereign Order No. 11.949 of 3 June 2026 and Ministerial Order No. 2026–305 of 3 June 2026 (JDM No. 8804 of 19 June 2026) implement Law No. 1.561 of 2 July 2024 on the right to be forgotten and other measures facilitating access to credit: processing of insurance applications; medical conditions covered by the right to be forgotten; reference tables for access to insurance without a premium surcharge or exclusion of cover, or with a capped premium surcharge, or under acceptance conditions approximating standard terms; conditions for exemption from providing information regarding health status or undergoing medical examinations, etc.

◾Increase in the National Minimum Wage (SMIC) and the minimum wage for apprentices on 1 June 2026

Circulars No. 2026-7 and No. 2026-8 of 26 May 2026 (JDM No. 8802 of 5 June 2026) set out the new rates for the S.M.I.C. (minimum inter-professional growth wage) (+2.41%). For those aged 18 and over, the gross hourly rate has risen (from €12.02) to €12.31, equating to a gross monthly wage of €2,080.39 (instead of €2,031.38 previously, for a 39-hour working week, i.e. 169 hours per month).

Similarly, Circular No. 2026-9 of 26 May 2026 (JDM of the same day) sets out the revised scales for the minimum wages of apprentices bound by an apprenticeship contract.

The minimum wages must be increased by a special allowance of 5% of their amount (Article 2 of Ministerial Order No. 63-131 of 21 May 1963 setting the minimum wage rates).

INTERNATIONAL TAXATION

◾Tax Treaty between the Principality of Monaco and the United Arab Emirates (UAE)

Sovereign Order No. 11.964 of 12 June 2026 (JDM No. 8804 of 19 June 2026) has given effect to the Convention between the Government of the Principality of Monaco and the Government of the United Arab Emirates for the elimination of double taxation with respect to taxes on income and for the prevention of tax evasion and tax fraud, based on the OECD Model Tax Convention on Income and on Capital. It applies to income tax and corporation tax in the United Arab Emirates, as well as to tax on profits from commercial activities levied on individuals and on profits levied on companies in the Principality of Monaco. It contains a clause on the exchange of information.

The following texts implement Monaco 2026–2028 Strategy for preventing corruption in senior executive functions, adopted in accordance with the recommendations of the Fifth Evaluation Round of the Council of Europe Group of States against Corruption (GRECO).

◾Transparency in State public procurement

Sovereign Order No. 11.976 of 18 June 2026 and Ministerial Order No. 2026-335 of 18 June 2026 (JDM No. 8805 of 26 June 2026) amend respectively Sovereign Order No. 7.264 of 20 December 2018 governing State public procurement, and Article 24 of Ministerial Order No. 2022-708 of 12 December 2022, which lays down the procedures governing the award of public building and civil engineering works contracts by the State.

Public access to information regarding administrative actions

Sovereign Order No. 11.975 of 18 June 2026, amending Sovereign Order No. 1.635 of 30 April 2008, supplemented by Ministerial Order No. 2026-334 of 18 June 2026 (JDM No. 8805 of 26 June 2026) tasks the Department of Human Resources and Civil Service Training with making public information regarding personnel movements within the State civil service.

◾Principles and rules governing the ethics, professional conduct and compliance of Members of the Sovereign House

The Sovereign Decision dated 18 June 2026 (JDM No. 8805 of 26 June 2026) establishes the principles and rules governing the ethics, professional conduct and compliance of Members of the Sovereign House serving in the following capacities: 1) Secretary of State, 2) Director or Head of the Sovereign Cabinet; 3) Adviser, or any other senior position involving management, policy development or inspection within the Sovereign Cabinet; 4) Adviser, Special Adviser, Private Adviser or First Adviser to the Sovereign; 5) Mission manager; 6) Administrator of the Sovereign Property.

Sovereign Order No. 11.971 of 18 June 2026 (JDM No. 8805 of 26 June 2026) updates Sovereign Order No. 9.931 of 15 June 2023 laying down the ethical, deontological and compliance principles and rules applicable to the Minister of State and Government Councillors-Ministers.

◾Protection, independence and promotion of the rights and freedoms of persons with disabilities

Law No. 1.591 of 18 June 2026 amending Law No. 1410 of 2 December 2014 (JDM No. 8805 of 26 June 2026), strengthens the rights of people with disabilities by modernising the financial support system, improving protection for family carers, and clarifying the rules relating to the status and employment of workers with disabilities.

Law No. 1.592 of 18 June 2026 (JDM No. 8805 of 26 June 2026) establishes the legal status of close carer ("proche aidant") for individuals who regularly assist an elderly person with reduced independence residing in the Principality, granting them specific rights, including protected unpaid leave and the option to request adjustments to their working hours.

◾Contribution to the remuneration of court-appointed representatives (protected person)

Order No. 2026–22 of the Secretary of State for Justice of 1 June 2026 (JDM No. 8804 of 19 June 2026) sets the annual income thresholds entitling the State to cover the remuneration of legal representatives appointed for the protection of individuals ("mandataires judiciaires à la protection des personnes"), at 100 per cent, 50 per cent or 25 per cent, depending on the resources of the person subject to a protection order.

◾Draft law No. 273 amending certain provisions of the Civil Code relating to divorce and legal separation (continuation of the legislative process)

The Government has issued a favourable opinion on the conversion into a Govenment bill of parliamentary Draft law No. 273, which continues the reform of Monegasque divorce law, notably by proposing the abolition of subjective grounds for divorce and the introduction of nuptial agreements into Monegasque law. The Government bill must be tabled by 1 June 2027 at the latest.

◾Bills Nos 1120 and 1121 concerning pensions for surviving spouses in the public and private sectors (passed)

Bills Nos. 1120 and 1121, passed on June 29, uphold the shared objective of equal treatment for surviving spouses, regardless of gender, regarding eligibility for survivor's pensions ("pension de réversion", the portion of the deceased insured person's retirement pension that is paid to their surviving spouse).

Draft law No. 275 on professional journalists (continuation of the legislative process)

The Government has issued a favourable opinion on the conversion into a Govenment bill of parliamentary Draft law No. 275 aiming to create a legal framework for the professional recognition of journalists (rights, guarantees, ethical duties) via a Monegasque press card issued by an independent commission. The Government bill must be tabled by 12 June 2027 at the latest.

Draft law No. 281 on strengthening measures to combat and prevent online hate speech (tabled)

Parliamentary Draft law No. 281 amends Law No. 1.383 of 2 August 2011 on the Digital Principality and Law No. 1.299 of 15 July 2005 on freedom of public expression, in order to strengthen the prevention and prosecution of online hate speech, in particular by establishing administrative and judicial procedures for the removal of unlawful content and by introducing the concepts of "AI systems" and "deepfakes" into Monegasque law.

◾Bill No. 1126 establishing a master plan for development and planning and containing various provisions relating to urban planning (received)

Government Bill No. 1126, received by the Parliament on 1 June, establishes a master plan for development and planning ("schéma directeur de développement et d'aménagement" SDDA) "providing a strategic framework for the organisation and development of the Principality’s territory"’, as well as the State’s land-use powers (including the right of pre-emption) to "manage the "rebuilding of the city on the city" (...) in the absence of any remaining land available for development", whilst "guaranteeing the future quality of life of residents and adaptation to climate change."

◾Draft law No. 280 regulating post-mortem organ donation and supplementing Law No. 1,073 of 27 June 1984 concerning the removal of tissue from the human body for therapeutic purposes (adopted)

Parliamentary Draft law No. 280, adopted on 11 June, aims to modernise the legal framework for post-mortem organ donation by creating a national donor register, recognising the role of the family in the absence of an expressed wish by the deceased, strengthening the protection of minors and adults under guardianship, and enshrining the principle of anonymity between donor and recipient.

Draft law No. 274 amending the effective annual rate applicable to the “Habitation Capitalisation” contract in the public sector (end of the legislative procedure)

The Government has announced its decision not to convert parliamentary Draft law No. 274 into a bill, on the grounds that “the financial consequences could eventually become unsustainable for the State”, whilst committing to table, by the end of the autumn parliamentary session, a bill providing for an alternative mechanism “inspired by traditional mortgage loans”. ◾Reduction in the duration of benefits for jobseekers whose employment contract has ended following a mutually agreed termination ("rupture conventionnelle")

French Law No. 2026-470 of 11 June 2026 (JORF No. 0136 of 12 June 2026) transposed Amendment No. 3 of 25 February 2026 to the Memorandum of Understanding of 10 November 2023 on unemployment insurance, which sets the maximum duration of unemployment benefit following an individual contractual termination (RCI) with effect from 1 September 2026, at 15 months for those under 55 (compared with 18 months at present) and at 20.5 months for those over 55 (compared with 22.5 months at present for those aged 55–56 and 27 months from the age of 57), although older workers may apply for an extension of their benefits, which will be assessed on a case-by-case basis.

This measure applies to employees in Monaco whose job loss results from a contractual termination as defined by Law No. 1.583 of 2 December 2025 and who are entitled to the return-to-work assistance allowance (ARE) funded by the French organisation UNEDIC (Amendment of 6 June 2025 extending the territorial scope of the agreement of 15 November 2024 on unemployment insurance to the territory of Monaco).

◾New website for the Department of Justice (Direction des Services Judiciaires "DSJ")

On 16 June, the DSJ officially launched its new website, https://www.justice.mc/, which is organised into sections covering, in particular, the judicial system, the courts, judicial bodies and professions, news, statistics on the justice system, procedures (legal aid, compensation for victims of crime), and publications, including journals and books.

◾80th Anniversary of the Labour Tribunal

The 80th anniversary of the Labour Tribunal was celebrated on 24 June. It was established by Law No. 446 of 16 May 1946, primarily to conciliate, and adjudicate in the event of failure, disputes between employers and employees arising from employment contracts, as well as disputes between employees arising from their work (with the exception of claims for damages resulting from accidents) (Government press release of 25 June 2026).

◾IMSEE: Monaco in Figures 2026

On June 23, the Monegasque Institute of Statistics and Economic Studies (IMSEE) published the 2026 edition of "Monaco in Figures", the annual compendium of the economic, social, demographic, and territorial statistics, featuring two new additions. First, employment data is now supplemented by new wage statistics, broken down by gender and age group. Second, the sectoral classification has changed, increasing from 12 to 14 Major Activity Sectors (GSA) (addition of the "Arts, sports, and recreational activities" and "IT, telecommunications, and media" sectors). This shift follows the adoption of the new NAF (French classification of activities) as of 1 January 2026.

COUNCIL OF EUROPE

◾2026–2028 Strategy to Combat Corruption in Senior Executive Positions in Monaco

On 1 June, the Government published the 2026–2028 Strategy to Combat Corruption in Senior Executive Positions (ministerial posts, senior non-ministerial executive posts, the judiciary, the Prince’s Palace), implementing the recommendations of the Group of States against Corruption (GRECO) of the Council of Europe as part of the 5th evaluation round (Government press release of 1 June 2026).

◾Report on Monaco of the European Commission against Racism and Intolerance (ECRI)

The 5th Report on Monaco (CRI(2026)15, 7th monitoring cycle) of the European Commission against Racism and Intolerance (ECRI) of the Council of Europe, adopted on 17 March 2026, was published on 9 June. It contains recommendations on the following areas: preventing and combating hate speech and hate crimes; ensuring equal treatment and inclusion in education; national legislation on preventing and combating discrimination; specific legal framework regarding equal rights for LGBTI people; and the situation of non-nationals in the field of employment.

◾Monaco Monitoring Report of the Global Forum on Transparency and Exchange of Information for Tax Purposes

Published on 19 June, the Enhanced Monitoring Report on the implementation of the standard on transparency and exchange of information on request of the Organisation for Economic Co-operation and Development (OECD) notes that Monaco has rectified the shortcomings identified in 2018 regarding the availability and updating of information on the beneficial owners of companies, as well as the supervision of chartered accountants/statutory auditors and notaries.

FATF

Adoption of Monaco fourth progress report and forthcoming on-site visit by the FATF

The Financial Action Task Force (FATF) has adopted the fourth progress report submitted by Monaco with a view to its removal from the grey list, and concluded “on a preliminary basis that Monaco has largely completed the implementation of its entire Action Plan drawn up in June 2024” (Government press release of 19 June 2026).

◾New online service to simplify applications for business start-up support

Monegasque entrepreneurs or their spouses wishing to benefit from the business start-up support scheme (covering social security contributions and part of business rent for 3 years) can now complete the process entirely online https://teleservice.gouv.mc/aide-installation-professionnelle/ (providing details of their business, submitting supporting documents and tracking the progress of their application without having to physically submit files to the Direction du Développement Économique "DDE"). (Government press release of 3 June 2026).

New online service for registering recreational fishing from the shore

The new online service https://teleservice.gouv.mc/declaration-peche/ enables users to complete the mandatory recreational fishing declaration (for adults and children) valid for three years, introduced in 2025 and governed by Article O. 244-8 of the Sea Code and Ministerial Order No. 2025–126 of 12 March 2025 (Government press release of 16 June 2026).

INTERNATIONAL

Investment Promotion Policy: The Government launches “Invest Monaco”

As the new name for the Cellule Attractivité, Invest Monaco's remit is as follows: "attracting new talent, residents and investors; promoting the growth of businesses and high-value-added activities; and strengthening the Principality’s visibility and influence on the world stage" (Gouvernment press release of 8 June 2026).

◾Establishment of diplomatic relations with the Kingdom of Bhutan

On 8 June, the Permanent Representatives of the Principality of Monaco and the Kingdom of Bhutan to the United Nations (New York) signed a joint communiqué establishing diplomatic relations between the two countries, which have "several areas of common interest, notably sustainable tourism, education, the environment and sport, which were identified as areas with strong potential for future bilateral cooperation“ (Government press release of 10 June 2026).

◾Monaco joins the Alliance for Torture-Free Trade

On 9 June, Monaco adhered to theAlliance for Torture-Free Trade, established and co-chaired by the European Union (EU), Argentina and Mongolia, with the aim of ending the trade in goods used for capital punishment and torture (Government press release of 23 June 2026).
