Thomas Giaccardi interviewed by Monaco Hebdo on the project to introduce the guilty plea procedure in the Principality

Monaco Hebdo magazine gathered the analysis of Thomas Giaccardi, in his capacity as avocat syndic rapporteur for the Monaco Bar, on the introduction of the guilty plea procedure in the Principality.

Bill No. 1118 establishing procedures for guilty pleas (for individuals) and penal agreement (for legal entities and the individuals representing them) was tabled at the Parliament's public session on 6 November 2025 and referred to the Legislation Committee.

The reform has two objectives:

1. Compliance with Financial Action Task Force (FATF) standards and MONEYVAL recommendations regarding the strengthening of the powers of the public prosecutor's office in matters of confiscation and provisional measures for all offences underlying money laundering.
2. Modernisation of criminal procedure by supplementing the traditional model of criminal trials with more flexible and rapid mechanisms adapted to new forms of crime.
