Maintaining the current patent: increase in rates (annuities) from 1 April 2023

Sovereign Order no. 9.794 of 1st March 2023 amending Sovereign Order n° 6.722 of 26th December 2017 fixing the amount of fees applicable to the performance of administrative formalities in respect of industrial property, as amended (JDM n° 8633 of 10th March 2023) increased the rates of the annual fee (annuity) that must be paid in order to maintain one's patent in force, applicable as from 1st April 2023, as follows:

— from the 1st to the 4th year: no change

  • The first: 1 euro
  • The second: 30 euros
  • The third: 50 euros
  • The fourth: 55 euros

from the 5th to the 8th year: €5 increase

  • fifth: (90) 95 euros
  • sixth (125) 130 euros
  • seventh (140) 145 euros
  • eighth (145) 150 euros

— from the 9th to the 11th year: €10 increase

  • ninth (155) 165 euros
  • tenth (175) 185 euros
  • eleventh (220) 230 euros

— from the 12th to the 14th yearly instalment: €15 increase

  • twelfth (255) 270 euros
  • thirteenth (290) 305 euros
  • fourteenth (335) 350 euros

from the 15th to the 20th yearly instalment: €20 increase

  • fifteenth (350) 370 euros
  • sixteenth (365) 385 euros
  • seventeenth (375) 395 euros
  • eighteenth (380) 400 euros
  • nineteenth (400) 420 euros
  • twentieth (430) 450 euros

The amount of the fees is fixed as follows for the :

1) Filing of a patent application: 30 euros

2) Filing an application for a certificate of addition: 50 euros

3) Conversion of a certificate of addition application into a patent application: 15 euros
