Bill No. 1136 on the practice of midwifery
Bill No. 1136 on the practice of midwifery was received by the Parliament on 16 October 2026.
SUMMARY
Bill No. 1136 continues the modernisation of the medical and paramedical professions, following on from those of dental surgeons (Act No. 1.434 of 8 November 2016) and pharmacists (Act No. 1.518 of 23 December 2021), just as Bill No. 1135 on the practice of medicine received on the same day by the Parliament.
On the one hand, it incorporates the provisions of Order of 29 May 1894 on the professions of doctor, surgeon, dentist, midwife and herbalist, as amended repealed (by the aforementioned Bill No. 1135) provisions relating to medical procedures and treatments that midwives may prescribe or carry out, recently updated by Law No. 1.525 of 16 May 2022, which had expanded their powers in relation to prescribing and vaccination, by adopting the standards set out in French legislation.
Furthermore, it revises the authorisation scheme for practising as a registered midwife, partner, locum, or on an ad hoc or occasional basis, to ensure the smooth running of the practice of a registered midwife who is undergoing training or has died.
Finally, it provides for criminal penalties in the event of non-compliance, including with Sovereign Order No. 7.786 of 14 November 2019 concerning the rules governing the practice of midwifery.
