Electric or rechargeable hybrid vehicle • New penalty for obstructing stopping or parking

Sovereign Order n° 10.530 of 23 April 2024 (JDM no. 8693 of 3 May 2024) inserts new provisions into the Code de la Route (Sovereign Order n° 1.691 of 17 December 1957 regulating road traffic police) penalising the hindering stopping or parking of electric vehicles or rechargeable hybrid vehicles.

The new article 32-2 of the Code de la Route states that:

"The stopping or parking of an electric vehicle or a rechargeable hybrid vehicle in a space reserved for this category of vehicle is prohibited and is considered a nuisance to public traffic when it takes place under one of the following conditions:

  1. It is not being recharged ;
  2. It remains parked after it has been fully recharged".

Penalties under article 207 of the Code de la Route:

Obstructive stopping or parking of an electric or rechargeable hybrid vehicle is punishable by a fine of €45 to €75.

The vehicle may be impounded
by enforcement officers at the offender's expense and risk.

Infringements committed in public car parks may be recorded by specially sworn officers of the Service des Parkings Publics. In the event of an offence being recorded in this way, the vehicle may be impounded by the authority's agents at the offender's expense and risk.
