Bill No. 1138 amending Article 25 of Law No. 1.096 of 7 August 1986 on the status of the Commune civil servants

Bill No. 1138 amending Article 25 of Law No. 1.096 of 7 August 1986 on the status of the Commune (town of Monaco) civil servants (sole clause) was received by the Parliament on 22 October 2026.

SUMMARY

The purpose of Bill No. 1138 is to set out the composition of the Commune Commission, which has been as follows since its reform under Law No. 1.538 of 16 December 2022, "modelled on the provisions applicable to the State Civil Service Commission established by Article 26 of Law No. 975 of 12 July 1975, as amended" (Explanatory Memorandum to Bill No. 1138):

  • local councillors;
  • representatives of the Commune civil servants;
  • representatives of the Commune administration;
  • representatives of associations whose purpose is to defend the professional interests of civil servants, duly incorporated and registered in accordance with Law No. 1.355 of 23 December 2008 on associations and federations of associations, as amended.

Bill No. 1138 aims to "reinstate [in Article 25 of Law No. 1.096] the option, as a secondary measure - in the absence of trade union or association representation - to call upon elected Commune civil servants to complete the composition of the local authority staff committee” (ibid.), as was the case prior to its reform issued from Law No. 1.538 of 16 December 2022.

Indeed, the purpose of this specific provision, according to the preparatory work of Law No. 1.096, “was to take account of the relatively small number of permanent staff and the limited number of civil servants in certain local authority departments, which, in the absence of trade union representation, could lead to a deadlock in the consultation procedure of the Commune Commission established by the Law. ” (ibid.)
