Bill no. 1110 amending law no. 1.410 of 2 December 2014 on the protection, autonomy and promotion of the rights and freedoms of persons with disabilities
Bill no. 1110 amending law no. 1.410 of 2 December 2014 on the protection, autonomy and promotion of the rights and freedoms of persons with disabilities (2025-06, 12 June 2025), was received by the Parliament on 25 June 2025.
Note: on 21 December 2023, Parliament received draft law no. 260 amending Law No. 1.410 of 2 December 2014 on the protection, autonomy, and promotion of the rights and freedoms of persons with disabilities (of parliamentary origin), which was referred for study to the Committee on Social Interests and Miscellaneous Affairs (CISAD).

Presentation
Law no. 1.410 is the framework law covering the situation of people with disabilities in its entirety: definition and status (Title I), access to care (Title II), reception and schooling (Title III), family life (Title IV), working life (Title V), guaranteed resources (Title VI), accessibility (Title VII), criminal provisions reinforcing the protection of people with disabilities (Title VIII).
It was drawn up in accordance with the provisions of the United Nations Convention of 13 December 2006 on the Rights of Persons with Disabilities (CRPD), which was signed on 23 September 2009 and has been in force for Monaco since 18 October 2017 (Sovereign Order no. 6.630 of 2 November 2017), the first binding international instrument in this field.
On 5 December 2023, the National Plan for the Inclusion of People with Disabilities "Handipact" was launched.
Government Bill no. 1110 aims to "introduce major innovations to strengthen the rights of people with disabilities and adapt them even more closely to the reality of each situation" (Explanatory memorandum to Bill no. 1110).

SUMMARY
Essentially, Bill no. 1110:
- revises the financial support system for disabled people: aid to guarantee a minimum income threshold, paid on the basis of the disabled person's resources (special education allowance, disabled adults' allowance, old-age disability allowance, supplemented, if necessary, by additional financial allowances); disability compensation allowances, paid on the basis of the disability compensation assistance plan drawn up by the Disability Assessment Commission ("Commission d'Evaluation du Handicap") (recurrent disability compensation allowance and exceptional disability compensation allowance);
- calls into question the principle that disabled people over the age of 60 should be treated as old-age pensioners, and provides for the possibility of applying for disabled status after that age;
- provides greater protection for parents who stop working to care for their child, for whom it is not possible to offer full-time schooling: home carer's allowance, with a system to ensure that there is no career break;
- institutes a disability assessment appeals board ("commission de recours d'évaluation du handicap") and a disabled worker orientation appeals board ("commission de recours d'orientation des travailleurs handicapés"),, with changes to the procedure for hierarchical appeals against decisions by the Director of Social Action and Assistance, taken in connection with the granting of disabled person status and disabled worker status.
